Most families come to me after a parent’s diagnosis, scrambling to figure out how to pay for care without losing the house, and the good news is that California changed its rules in 2024 so the old asset limit no longer applies to Medi-Cal. I’ve spent years helping Ventura County families coordinate long-term-care planning, powers of attorney, and protections against elder financial abuse before a crisis forces rushed decisions.
Elder Law & Medi-Cal FAQs
Does California still have a Medi-Cal asset limit for long-term care?
No. As of 2024 California eliminated the Medi-Cal asset limit, so the asset test no longer applies when qualifying for long-term-care coverage. Income rules and estate-recovery rules still matter, so planning is about more than just counting assets now.
Will the state take my house if I go on Medi-Cal?
California’s Medi-Cal estate recovery program can seek repayment from certain assets in a deceased member’s probate estate, but recovery is now limited mainly to assets that pass through probate. Holding your home in a properly structured trust is one common way Ventura County families avoid probate and reduce exposure to recovery.
What is the difference between elder law and basic estate planning?
Estate planning focuses on what happens after death, while elder law also covers the years of incapacity and care before death. That includes long-term-care funding, Medi-Cal coordination, durable powers of attorney, and protecting an elder from financial abuse.
When should I start elder law planning for a parent?
The best time is before a health crisis, while your parent still has the capacity to sign documents and make decisions. If a crisis has already hit, planning is still worthwhile, because California’s current Medi-Cal rules leave more room to act than most families expect.
