When that happens, you need someone who knows how to push a contested estate through the court without letting it drag on forever.

How do I remove an executor or administrator who isn’t doing their job?

You can petition the Ventura County Superior Court, Probate Division, to suspend or remove a personal representative for mismanagement, self-dealing, failing to account, or neglecting the estate. The court can appoint a successor and order the removed representative to repay losses they caused, but you’ll need documented evidence rather than just frustration.

What can I do if I think the executor is hiding money or assets?

You can demand a formal accounting and, if it doesn’t add up, ask the court to compel one and surcharge the representative for missing or misused funds. Courts take fiduciary breaches seriously, and the threat of personal liability often gets cooperation once a petition is on file.

How long do creditors have to make a claim against an estate?

In California, creditors generally must file a claim within four months after letters are issued to the personal representative, or within a short window after receiving notice, whichever is later. Claims filed late are usually barred, which is why proper notice and timely objections matter so much in a contested probate.
