Santa Barbara County has some of the highest property values in California and one of the most punishing probate fee structures in the country, and the two multiply. Probate Code §§ 10810 and 10800 set attorney and personal representative compensation as a percentage of the gross value of the estate. Gross, not net. The mortgage does not reduce it.
On a Santa Barbara house worth $1,600,000 with $900,000 still owed, the statutory fee is calculated on $1,600,000. Both the attorney and the personal representative are entitled to that amount, separately. Families discover this after the death, when the choice has already been made for them.

Getting that wrong costs a refiling fee and weeks. It is the first thing I confirm, and it is not always obvious for families spread between the valley and the coast.
Whether you need full probate at all
Not every estate does. California’s small-estate threshold is $208,850. An estate under that figure can often be handled with a small-estate affidavit rather than a full court proceeding, and real property below the limit has its own simplified petition.
Be careful with that number. Several California firm websites circulate a higher threshold that appears in no primary source and contradicts the three-year adjustment cycle under Probate Code § 890. If a site quotes you a bigger figure, ask where it comes from before relying on it.
A Santa Barbara house almost always clears the threshold on its own, so the affidavit route usually matters for the accounts and personal property rather than the real estate.
Working with an attorney who is not downtown
I do not have a Santa Barbara office and I will not pretend otherwise. What matters practically is that Santa Barbara Superior Court requires e-filing for probate and civil matters.
