A common tool is a trust that supports your surviving spouse during their lifetime and then passes the remaining assets to your children when your spouse dies. This prevents the all-too-common outcome where everything goes to the spouse outright and your children are unintentionally cut out.

Will my new spouse be able to disinherit my kids after I die?

If you leave everything to your spouse outright, they generally can later change their own estate plan and leave nothing to your children. Using a properly structured trust locks in your wishes so your children are protected no matter what your spouse does afterward.

What happens to a new spouse who isn’t named in an old will or trust?

California protects the omitted (pretermitted) spouse. Under Probate Code § 21610, a spouse you marry after signing your will or trust — and who isn’t provided for in it — is generally entitled to a share of your estate as if you had died without a plan, unless a § 21611 exception applies (you intentionally left them out and said so, you provided for them outside the document, or they waived their rights). In a second marriage this is a live risk, which is why blended-family plans often use a QTIP marital trust to support the surviving spouse for life while locking in that the remainder passes to your own children.
