Probate Attorney in Santa Barbara

Probate Attorney in Santa Barbara

At a glance

  • California probate fees are set by statute on the gross value of the estate, not the equity. A Santa Barbara house with a large mortgage still generates fees on the full value.
  • South County matters are heard at the Anacapa Division, 1100 Anacapa Street. North County goes to the Cook Division in Santa Maria.
  • Santa Barbara Superior Court requires e-filing for probate, so where your attorney sits makes no difference to how fast a petition moves.
  • Estates under $208,850 may avoid full probate entirely.

Santa Barbara County has some of the highest property values in California and California sets probate fees by statute as a percentage of the estate, so the two multiply. Probate Code §§ 10810 and 10800 set attorney and personal representative compensation as a percentage of the gross value of the estate. Gross, not net. The mortgage does not reduce it.

On a Santa Barbara house worth $1,600,000 with $900,000 still owed, the statutory fee is calculated on $1,600,000. Both the attorney and the personal representative are entitled to that amount, separately. Families discover this after the death, when the choice has already been made for them.

Which division your case goes to

It depends on where the person lived. South County, meaning Santa Barbara, Montecito, Goleta and Carpinteria, is heard at the Anacapa Division, 1100 Anacapa Street in Santa Barbara. North County, meaning Santa Maria, the Santa Ynez Valley, Lompoc and Guadalupe, goes to the Cook Division, 312 East Cook Street, Building E, in Santa Maria.

Getting that wrong costs a refiling fee and weeks. That’s the first thing to confirm, and it isn’t always obvious for families spread between the valley and the coast.

Whether you need full probate at all

Not every estate does. California’s small-estate threshold is $208,850. An estate of $208,850 or less can often be handled with a small-estate affidavit rather than a full court proceeding, and a primary residence worth $750,000 or less has its own simplified petition (Prob. Code § 13151).

Be careful with that number. Several California firm websites circulate a higher threshold that appears in no primary source and contradicts the three-year adjustment cycle under Probate Code § 890. If a site quotes you a bigger figure, ask where it comes from before relying on it.

A Santa Barbara house almost always clears the threshold on its own, so the affidavit route usually matters for the accounts and personal property rather than the real estate.

By the Census Bureau’s estimate, 16,384 of Santa Barbara’s 39,204 homes, about 42%, were built before 1960 (American Community Survey, 2020 to 2024).

Working with an attorney who is not downtown

I do not have a Santa Barbara office. What matters practically is that Santa Barbara Superior Court requires e-filing for probate and civil matters. The paperwork moves through the court electronically whether the filing attorney is three blocks from Anacapa Street or an hour south.

Most probate hearings do not require the family to appear at all. Where a signature needs a notary, I arrange a local notary and witnesses so you are not the one driving. California has not authorized remote online notarization for general use, so that step still happens in person, with somebody local to you.

Questions Santa Barbara clients ask

The house has a big mortgage. Does that reduce the probate fee?

No, and this is the single most expensive surprise in California probate. Probate Code §§ 10810 and 10800 calculate compensation on the gross value. A $1,600,000 Santa Barbara house with $900,000 owed is treated as $1,600,000 for fee purposes.

Do I file in Santa Barbara or Santa Maria?

It depends where the decedent lived. Santa Barbara, Montecito, Goleta and Carpinteria go to the Anacapa Division at 1100 Anacapa Street. Santa Maria, the Santa Ynez Valley and Lompoc go to the Cook Division at 312 East Cook Street, Building E.

Is the estate small enough to skip probate?

The California threshold is $208,850. Some firm sites quote a higher number that does not appear in any primary source, so check the figure before relying on it. A Santa Barbara house on its own usually exceeds the limit, but the accounts and personal property may still qualify for the affidavit.

Does it slow things down that you are not in Santa Barbara?

No. The court requires e-filing for probate, so filings move electronically regardless of where the attorney sits. Most hearings do not need the family present, and I arrange a notary local to you for signing.

How long does a Santa Barbara probate take?

In my practice I tell clients to plan on twelve to eighteen months from filing to final distribution. That is my working figure. The California Courts self-help materials describe roughly nine months to a year and a half.
