Probate Attorney in Agoura Hills
Probate Attorney in Agoura Hills
At a glance
- Los Angeles County hears probate downtown at the Stanley Mosk Courthouse, 111 N. Hill Street. There is no Valley probate court.
- Fees are statutory on the gross value under Prob. Code §§ 10810 and 10800, so a low assessed value does not mean a low fee.
- Agoura Hills homes bought in the 1970s and 1980s are the classic case: modest tax bill, very large market value.
- Estates of $208,850 or less may avoid full probate. An Agoura Hills house on its own will not.
The recurring Agoura Hills probate is a house bought decades ago by parents who stayed in it. The property tax bill has stayed low, which makes families badly underestimate what the estate is worth and what probate will cost.
How the statutory fee is calculated is on the California probate page. The Agoura Hills trap is the gap between the two numbers a family sees: a Proposition 13 assessed value frozen decades ago, and a current market value the fee is actually based on.

Talk to EricThe gap between the tax bill and the fee
A house bought in 1981 for $140,000 may be assessed near that figure today under Proposition 13 and be worth well over a million. The annual property tax reflects the old number. The probate fee reflects the new one.
Families see a $1,900 tax bill and assume a modest estate. That expectation gap is the most unpleasant conversation in an Agoura Hills probate file, and it is entirely avoidable while the parents are living.
By the Census Bureau’s estimate, 6,792 of Agoura Hills’ 7,566 homes, about 90%, were built between 1960 and 1999 (American Community Survey, 2020 to 2024).
| Built | Homes |

| Before 1960 | 341 |

It is a downtown filing, repeatedly
Los Angeles County centralizes probate at the Stanley Mosk Courthouse, 111 N. Hill Street. There is no Valley probate court, so the courthouse nearest Agoura Hills is not the one that hears this.
Most of a probate does not require the family in a courtroom, and I handle the filings. But the case sits on a busy downtown calendar, which is the main reason Los Angeles probate runs at the longer end of the twelve to eighteen months I tell clients to plan for.
Where an Agoura Hills probate is heard. Under Los Angeles Superior Court Local Rule 4.3(a), every probate matter outside the North District is filed and heard at the Stanley Mosk Courthouse, 111 N. Hill St. in Los Angeles. The probate clerk’s office is on the 4th floor, in Room 429.
If a child has been living there as caregiver
This is common in Agoura Hills and it complicates a probate. An adult child who moved in to care for a parent is often still in the house when the parent dies, sometimes with no lease, no ownership and no written agreement.
That child is usually a beneficiary too, so the question is not only whether they can stay but how their occupancy is accounted for against their share while the estate is administered. Siblings who did not provide the care frequently see it differently. Raising it early, in writing, is what keeps it from becoming the dispute that consumes the estate.
The schedule on a typical Agoura Hills home, next to the shortcuts
On Zillow’s typical Agoura Hills home the statutory schedule allows the executor and the attorney $25,344 each, or $50,688 combined. In ZIP 91301 the typical home is $1,220,678 and the same schedule allows $25,207 each. Both figures come from the schedule in Prob. Code § 10800 and § 10810, applied to an estate made up of only the house. Most real estates run higher, and the number is what the schedule allows, not what a family will necessarily pay.
| Test | Limit | Typical Agoura Hills home ($1,234,398) |
|---|---|---|
| Small estate affidavit (§ 13100) | $208,850 | Over by $1,025,548 |
| Primary residence petition (§ 13151) | $750,000 | Over by $484,398 |
| Full probate | None | Applies, and the fee is on gross value |
The result is that an Agoura Hills house left outside a trust goes through full probate unless it passes some other way. See small estate limits and home values for how the thresholds work.
The schedule covers ordinary services only. The court may also allow additional compensation to the attorney for extraordinary services in an amount it finds just and reasonable. A disputed occupancy, a sale, or a fight among siblings can push a file into that territory, which is why the caregiver arrangements described above belong in writing early.
The inventory, the appraisal and the property tax filing
The first big filing after appointment is the inventory and appraisal. The personal representative files it within four months after letters are first issued to a general personal representative, unless the court allows more time. That’s the date the family’s figure for the house becomes a court record, and it’s also the number the fee is figured on.
The property tax paperwork is due with it. The personal representative files a change in ownership statement with the county recorder or assessor, and it has to be filed before the inventory or at the same time. The inventory filing includes a certification that this was done. A family that misses the property tax step can find the court asking about it.
Agoura Hills is Los Angeles County, so the assessor is the Los Angeles County Assessor and the recorder is the Registrar-Recorder/County Clerk. I handle those filings for the executor.
After the court order: recording the house in Los Angeles County
When the court orders the house distributed, the order or a deed under it is recorded with the Los Angeles County Registrar-Recorder/County Clerk. The county lists real property recording at Van Nuys and at its Norwalk headquarters, at 12400 Imperial Hwy. A transfer by reason of death carries an exemption from the documentary transfer tax.
The house may sit empty for months while all this happens, and Agoura Hills is a wildfire place. CAL FIRE adopted new fire hazard severity zone maps for state responsibility areas in 2024 and released recommended maps for local areas in 2025. If a vacant house needs someone with authority before letters issue, the court can appoint a special administrator when the circumstances require an immediate appointment. Talk to the insurer early about vacancy terms, because a policy written for an occupied home may not cover an empty one.

Questions Agoura Hills clients ask
Our parents’ tax bill was small. Does that mean a small estate?
No, and this is the most expensive misunderstanding in Agoura Hills probate. Proposition 13 kept the assessed value near the 1980s purchase price. Probate fees under §§ 10810 and 10800 are calculated on current gross market value.
Where is an Agoura Hills probate filed?
Downtown at the Stanley Mosk Courthouse, 111 N. Hill Street. Los Angeles County centralizes probate there and there is no Valley probate court.
Does the mortgage reduce the fee?
No. The calculation is on gross value, not equity. A house worth $1,400,000 with $500,000 owed is treated as $1,400,000.
My sibling lived with our mother as her caregiver. Can they stay in the house?
It depends on the will or trust and on what the beneficiaries agree. What is not optional is accounting for the occupancy while the estate is administered. Getting that in writing early prevents most of these disputes.
How long does it take?
In my practice, plan on twelve to eighteen months from filing to final distribution. Los Angeles is among the busiest probate courts in the state, so the longer end is realistic.
How soon after appointment is the inventory due?
Within four months after letters are first issued to a general personal representative, unless the court allows more time. That deadline runs from the date the letters issue.
Would a typical Agoura Hills house qualify for the primary residence petition?
Not at the typical value. The petition covers a home up to $750,000 for deaths on or after April 1, 2025, and Zillow’s typical Agoura Hills value is $1,234,398. A house bought decades ago can be worth far more than its tax bill suggests.
Do the heirs pay transfer tax when the court distributes the house?
The documentary transfer tax doesn’t apply to a transfer by reason of death, outright or in trust. Property tax reassessment is a separate track, which the change in ownership statement starts.
