Does adding my child to my deed avoid probate?
Holding title in joint tenancy can pass property to the surviving owner outside probate, but it comes with real downsides like exposing your home to your child’s creditors and triggering gift-tax and capital-gains issues. In most cases a trust or transfer-on-death deed is a safer way to avoid probate, and I’ll walk you through which fits your situation.
What is a life estate and when does it make sense?
A life estate lets you keep the right to live in and use your property for life while naming who automatically receives it when you pass. It can avoid probate on that parcel, but it limits your ability to sell or refinance without the remainder beneficiary’s cooperation, so it’s worth weighing the tradeoffs before recording one.
How do I transfer real property out of a deceased person’s name in California?
It depends on how title was held. Joint tenancy or trust-held property often transfers with a simple affidavit or trustee’s deed, while property held in the deceased person’s name alone usually requires probate through the Ventura County Superior Court, Probate Division, unless the estate qualifies for a small-estate procedure.
Will transferring my property reassess my property taxes?
Many transfers trigger reassessment, but several exclusions exist, including certain transfers into your own revocable trust and qualifying parent-child transfers. Because the rules changed significantly under Proposition 19, I always review a proposed transfer for reassessment exposure before any deed is recorded.
